| BIS: The Dept for Business, Innovation & Skills was formerly the dept for Business Enterprise & Regulatory Reform (BERR) and was previously the Dept of Trade & Industry (DTI).
Commercial and financial investigations are almost always complex and the consequences serious. They are often confusing for the businessman who has no experience of what is happening. Being asked to account to the authorities for what concluded many years previously can be a minefield without the correct advice and representation.
Cartwright King has several highly experienced business defence lawyers who are able to represent your interests at all stages, including conducting a forensic analysis of evidence and finances, if required.
BIS investigates and prosecutes commercial behaviour through its Companies Investigation Branch (CIB). This could be as a result of a report by the Official Receiver or a liquidator following liquidation, the report of a Judge or a complaint by other companies or members of the public.
We offer expert defence in relation to:
• Trading whilst insolvent (Fraudulent Trading) • Directors’ duties under the Companies Acts • Failing to keep accounting records • Non-cooperation with Insolvency Service, Official Receiver (OR), or liquidator • Shadow directors • Disqualified directors • Bankruptcy infringements • Restraint Orders • Serious Crime Prevention Orders
Other agencies: There are many other agencies in the commercial and financial arenas (eg. Companies House, Financial Services Authority, etc,) that investigate and prosecute, as well as specialist and often technical, industry-specific bodies (eg. Food Standards Agency, DEFRA, CAA, General Dental Council, etc). We have dealt with them all in their various guises. Our flexibility and expertise enables us to defend your interests.
